Terms and conditions for all program affiliates
1. Accepting a partnership with AdultADV:
The partnership is personal: So AdultADV reserves the right
to refuse any requests that do not conform to this program,
without any need to provide justification. In particular, but
not only, all requests will be refused from owners of websites
that contain images or content with violence, racism, pedophilia
or that may in any way harm the name and image of AdultADV.
At any time, also without advance notice, AdultADV shall be
entitled to terminate the partnership with owners of websites
that contain images or content with violence, racism, pedophilia
or that may in any way harm the name and image of AdultADV without
any indemnity whatsoever. The Affiliate is also entitled to
rescind from the partnership at any time without advance notice.
In any case AdultADV shall not be held liable for the Affiliate’s
website content.
The affiliate takes responsibility for data entered while registering
in the affiliation program with AdultADV.
2. Commissions:
AdultADV shall pay the affiliate for every click and impression
coming from the affiliate’s site. AdultADV shall provide
the affiliate with a table showing commissions accrued in real
time through their website when the partnership starts up.
The affiliate can also see in real time the payment formulae
and commissions recorded.
3. Identification of visitors:
Clicks and impressions from the affiliate’s website are
identified through the account of the affiliate in the link
to the AdultADV network. Under no circumstances will AdultADV
be held liable for any technical errors made by affiliates or
their representatives when entering the code for the link and
images. AdultADV shall not be held liable for temporary suspension
of service and/or technical issues, not depending on their will,
which prevent registering the number of clicks and impressions
made on banners on the affiliate’s website, due to failures
and/or service suspension and/or technical issues caused by
third parties. Furthermore, since current Internet protocols
cannot guarantee certain and constant quality communication,
issue or receipt of messages, integrity of files sent, or the
identity of users, AdultADV cannot be held liable for total
or partial failure of means or services that compose or are
used by the Internet.
4. Commission payment:
Commission payment to the affiliate is made as soon as they
have reached a minimum amount of 500,00 Euro. These commissions
include all amounts accrued thanks to the various campaigns.
They are calculated month after month and will be paid in the
month after the calculation.
The credit will be deposited in USD the date of the actual payment and it
will take in consideration the latest conversion rate provided by
If the affiliate wants to end the Partnership with AdultADV
and has a credit lower than this amount, they can request payment
for commissions accrued up to that time.
5. Definition of clicks and impressions:
A click is an action performed by the user who clicks a banner
or link to enter a site in the AdultADV network. The click is
counted if the IP address is the only one over the 24 hours
(session time) after the click itself. Contrarily, the click
is not counted.
An impression, show/view banner or link to the AdultADV network
on the affiliate’s website.
6. Definition of affiliate:
An affiliate is any Webmaster who has entered a code on pages
on their website(s) to access sites in the AdultADV network.
7. Definition of commission:
The amounts set for every click and impression shall be credited
to the personal account of the affiliate (see also art. 2 above).
8. Miscellaneous:
It is expressly agreed that access to web pages linked to AdultADV
and programs and data contained in them does not give the affiliate
any entitlement to the pages and content, which remains the
exclusive property of the respective authors and editors.
It is necessary to bear in mind that certain behaviors that
are prohibited:
1. Force or entice clicks on banners proposed
by AdultADV to access the site or menus on the site of the affiliate;
2. Create a link on the site of the affiliate
that automatically sends visitors to merchant sites in the AdultADV
network without explicit indication;
3. Create a link that opens a window on a
page on the affiliate’s website and at the same time opens
another one on the site of merchants in the AdultADV network;
4. Send the code or other content (banner,
link or pop-under) provided by AdultADV to external sites and/or
services (chats, forums, newsgroups and newsletters) to the
site of the affiliate registered with AdultADV;
5. Use tools to artificially increase the number of clicks
and impressions;
6. Enter their code on sites of other affiliates
and sites in a different language from that indicated when registering;
7. Enter codes of campaigns on sites other
than their own.
(N.B.: The affiliate is able, through the panel provided by
AdultADV, to register on more than one site in the AdultADV
affiliation program, using a single account to manage the various
sites);
8. Open a dialog window that proposes to click
AdultADV banners.
9. It is not possible to enter, on a webpage,
more than 3 codes per area.
It is strictly prohibited to artificially change and/or manipulate
the number of clicks and impressions from the affiliate’s
website.
The affiliate’s site shall place on their pages the code
provided by AdultADV without changing it in any way.
Additionally, if there is any behavior that is prohibited by
these regulations or against the spirit of the regulations,
AdultADV reserves the right to terminate the relationship with
the affiliate at any time without paying for clicks and impressions.
The partnership in question is not exclusive with the affiliate
for an indefinite period of time, without prejudice to the fact
that any of the parties may end the partnership at any time.
These general conditions can be changed by AdultADV only.
If the changes mentioned effect the calculation of commissions
due, the affiliate shall be informed immediately. They shall
come into effect the month following the change unless the affiliate
informs AdultADV that they wish to terminate the partnership
prior to the above-mentioned time. The parties undertake to
reach an amicable agreement should any dispute arise on the
interpretation, execution or termination of the partnership.
The parties declare that they have read and specifically approve
all terms set forth in the contract.
